Terms of Service
These Terms of Service apply toward non-commercial work only and may be revised or updated without notice.
- Listed example pricing is subject to change according to the complexity, difficulty, size and medium of each individual project.
- The Client shall provide the Artist with a concise description of their project including character references and other important details such as mood, setting, etc. as required. The Artist will provide a preliminary quote based upon this.
- The Artist will not depict scenes of illegal activities or hateful images. Tastefully or humorously offensive work may be considered on a case-by-case basis. The Artist reserves the right to reject a commission project for any reason.
- Payments shall be made in Canadian Dollars. Projects at $250CAD and under must be paid in full before work begins. For projects greater than this amount, half of the total amount may be paid as a deposit, with the remainder to be paid in full before receiving the finished piece.
- Project communication between the Client and the Artist shall be conducted via email only (gryxander[at]gmail.com) to ensure that all information is consolidated to a single location.
- The Artist will provide email updates to the Client on the progress of their commission as necessary. The Client is encouraged to contact the Artist for updates, inquires or reminders when necessary. Commission status may also be found HERE.
- Clients may request up to two major alterations during the sketch phase of a commission without penalty (not applicable to sketch commissions). Other minor requests may be made through the duration of the project at the Artist’s discretion. For any change requests outside these limits, a fee will applied to cover the work involved. Any revisions required as a result of the Artist overlooking previously provided information will not be counted toward the limit.
- The Artist may reuse any sketches or thumbnails rejected by the Client for other commissioned or personal work.
- The Artist will consider all feedback provided by the Client but retains the right to reject suggestions if the Artist feels it will negatively impact the quality of the piece as a whole.
- The Client may cancel their commission at any time. Refunds are issued depending on level of work already completed on the project: At the sketch stage up to 75% will be refunded. After that, only 50-25% may be refunded. No refunds are available on completed work.
- The Artist may cancel a commission and issue a refund at any time due to difficult/poor communication, rude or inappropriate behavior, or personal misfortune.
- The Client may not alter, edit or change the artwork without prior express consent given by the Artist. This includes but is not limited to colouring of sketches or linework, creating new elements in a piece, or hiring services of a third-party to do so. The Client is permitted to crop or resize artwork to create icons, wallpaper, or other digital graphics so long as the artwork itself remains unaltered.
- The Artist reserves the right to issue a takedown notice of edited artwork should Article 12 be broken between the Artist/Client Agreement.
- The Client retains full rights to their respective characters. The Artist makes no claim to ownership of the characters they are requested to depict, other than their own.
- The Artist retains all image and reproduction rights of commissioned artwork. As a courtesy, the Artist will contact the Client for consent should they wish to create prints or other merchandise from their commissioned piece. These image rights may be purchased by the Client at an additional fee.
- The Artist retains the right to upload and display commissioned work in their personal galleries and websites. Commissioned work intended as gifts can be delayed from exhibit until given to the intended recipient. The Client may pay a fee if they wish their piece to remain completely private/offline.
- The Client may repost or upload commissioned artwork to their own galleries with credit to the artist. The Client is permitted to make up to three copies/prints of commissioned artwork for personal, non-commercial use only.
- The Client may not profit from the artwork in any way other than resale of the original, physical copy of the work (traditional media). Digital files, copies made from files or any other merchandise created with the artwork are not permitted to be sold.
- By commissioning the Artist and upon sending payment, it is understood that the Client has read, understood and agrees to the above Terms of Service in full.
